Welcome to Back Road Controls! These Terms and Conditions govern the purchase and use of our products. By accessing our website, placing an order, or using our products, you agree to these terms.

1. GENERAL TERMS

• These Terms and Conditions apply to all purchases made directly from Back Road Controls, including pre-orders and retail sales.
• We reserve the right to update, modify, or replace any part of these terms at any time. Continued use of our products or website constitutes acceptance of any changes.

2. PRODUCT PURCHASES

A. Pre-Orders

1. Pre-orders are advance purchases for products not yet available for immediate shipment.
2. Payment is required at the time of pre-order placement.
3. Estimated shipping dates will be provided, but delays may occur due to manufacturing, supply chain, or unforeseen circumstances.
4. Customers will receive email updates regarding production progress and delivery timelines.
5. If we cannot fulfill a pre-order, a full refund will be issued.

B. General Sales

1. Orders are processed upon payment confirmation.
2. Shipping times vary based on location and selected shipping method.
3. All sales are final once shipped, except as outlined in the return policy below.

3. PRICING & PAYMENT

• Prices are listed in USD and are subject to change without notice.
• We accept major credit cards, PayPal, and other approved payment methods.
• Taxes and shipping costs will be calculated at checkout based on location.

4. SHIPPING & DELIVERY

• Orders are shipped via the best carrier available with tracking information provided.
• Customers are responsible for ensuring accurate shipping details.
• Back Road Controls is not liable for delays caused by third-party carriers.
• International orders may be subject to customs duties, which the buyer is responsible for.

5.  LIABILITY & LIMITATION OF USE 

• Back Road Controls is not responsible for any damage, injury, or loss resulting from improper use of the OTTR3.7.
• The user assumes all risks associated with modifying or upgrading their RC vehicles.
• The OTTR3.7 should be installed and used in accordance with provided instructions.

6. INTELLECTUAL PROPERTY

All designs, software, and branding associated with Back Road Controls and OTTR3.7 are the intellectual property of Back Road Controls.

• Unauthorized reproduction, resale, or distribution of our products and content is prohibited.

7. GOVERNING LAW

• These Terms and Conditions are governed by the laws of Kansas, United States
• Any disputes will be resolved in accordance with Kansas legal procedures.
